DOTENKO Terms of Use

1. Introduction

DOTENKO (hereinafter referred to as the "App") is a card game application for smartphones provided by tktk0330 (hereinafter referred to as "we," "us," or "our"). These Terms apply to all use of the App by users. By downloading and using the App, users are deemed to have accepted these Terms. Users are also deemed to have accepted these Terms even if someone other than the user uses the App on a communications device owned by the user.

2. Accounts

In the App, an account is automatically created through anonymous authentication using Firebase Authentication. Users are responsible for appropriately managing their own account information (username, icon, etc.). Transferring, selling, buying, or sharing accounts is prohibited.

3. Subscriptions (Paid Plans)

1. The App offers a free plan (Free) and paid plans (Premium Monthly and Premium Annual).
2. Paid plans are purchased through the Apple App Store, and Apple Inc.'s terms of use apply.
3. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
4. Subscriptions can be managed and canceled through the App Store account settings.
5. Refunds after purchase are subject to Apple Inc.'s policies.
6. If a free trial period is available, any unused portion expires when a subscription is purchased.

4. Online Matches

1. The online match feature is subject to a daily usage limit under the free plan and is available without limits under the paid plan (Premium).
2. If a connection loss or misconduct is detected during an online match, the match may be ended or invalidated.
3. We assume no responsibility if a connection with another player cannot be established during matchmaking.
4. The online match service may be temporarily unavailable due to maintenance or failures.

5. Prohibited Conduct

The following conduct is prohibited in the App.

1. Conduct that violates laws and regulations or public order and morals
2. Criminal acts, or announcing, participating in, or facilitating such acts
3. Using images that we consider obscene, such as photographs or illustrations of nudity or persons in underwear, or words that refer to or evoke sexual matters
4. Using images or words that infringe the rights of others
5. Using images or words that can identify individuals
6. Using images or words that defame individuals or third parties
7. Setting inappropriate usernames or icons
8. Using cheats, hacks, or unauthorized tools, or improperly manipulating the game
9. Unauthorized access to servers and other systems providing the App, and conduct that interferes with the operation of the services
10. Copying, reverse engineering, or modifying the App
11. Harassing or causing a nuisance to other users
12. Conduct that violates these Terms
13. Other conduct that we consider inappropriate

6. Removal of Content and Suspension of Accounts

If a user violates these Terms, or if we consider the user's conduct inappropriate, we may take the following measures without prior notice.

1. Removal or modification of content such as usernames and icons
2. Temporary or permanent suspension of accounts
3. Restrictions on use of the online match feature

7. Copyright and Other Intellectual Property Rights

1. All copyrights and other rights relating to the App belong to us or to third parties who hold those rights.
2. Users may use content provided through the App only on device models supported by the App.
3. Users must not republish, reproduce, modify, reverse engineer, or transmit the App without our permission.

8. Trademarks and Related Rights

Users must not apply to register patent rights, utility model rights, design rights, or trademark rights relating to the App (including the rights to obtain patents, utility model rights, and design rights), apply to register copyrights or transfers of copyrights, or exercise such rights.

9. Disclaimer

1. We make no warranties that the App is suitable for a user's particular purpose, has the expected features, commercial value, accuracy, or usefulness, or will be free from defects.
2. We may change the App's specifications or discontinue the services for our own reasons.
3. We assume no liability to compensate users for damages arising from the termination, modification, interruption, or unavailability of the App; loss of data or failure of or damage to equipment resulting from use of the App; or any other damages suffered by users in connection with the App.
4. We also assume no liability for damages arising from communication failures, server failures, matchmaking failures, or similar issues in online matches.
5. Problems between users: We will not become involved in, and assume no responsibility for, problems, disputes, or damages between users arising through online matches or other features. Problems between users must be resolved by the users themselves.
6. Third-party services: We assume no liability for damages arising from failures, changes in specifications, discontinuation, or similar events affecting third-party services used by the App, such as Firebase, Apple, and Google.
7. Purchase-related problems: Problems relating to subscription purchases, automatic renewals, refunds, and similar matters must be resolved with Apple Inc. We assume no responsibility for such problems.
8. Unauthorized use: We assume no liability for damages arising from unauthorized use of user accounts, impersonation, hacking, or similar acts by third parties.
9. Indirect damages: We assume no liability for lost profits, lost business opportunities, loss of data, or other indirect, incidental, special, punitive, or consequential damages arising from use of or inability to use the App.
10. Limit on damages: Even where our liability is recognized by law, our liability for compensation is limited to the amount the user paid for the App during the preceding 12 months. For users of the free plan, we assume no liability for compensation.
11. Users bear responsibility for any damages they suffer through use of the App, and we assume no liability whatsoever.

10. Compensation

If a user causes damage to us or to a third party by violating these Terms or by improperly using the App, the user must compensate for that damage (including attorneys' fees).

11. Support

We are not obligated to answer every inquiry from users regarding the App. When making an inquiry to us about the App, users must use the method specified by us.

12. Changes to These Terms

When changing these Terms of Use, we may modify, partially delete, or revise these Terms without prior notice to users. Users who continue to use the App after changes to these Terms of Use are deemed to have agreed to the revised Terms of Use.

13. Governing Law and Jurisdiction

These Terms are governed by Japanese law for purposes of interpretation. If a dispute arises in connection with the App, the court having jurisdiction over our location will have exclusive jurisdiction by agreement.
